ORDINANCE NO. 09-06
AN ORDINANCE REGARDING THE CHARGING OF FEES FOR
EMERGENCY MEDICAL AND RESPONSE SERVICES BY THE
LEMONT FIRE PROTECTION DISTRICT
WHEREAS, the Illinois Fire Protection District Act grants to the Board of Trustees of a fire protection district the authority to "fix, charge and collect fees for emergency ambulance service within or outside of the fire protection
district" (70 ILCS 705/22) and the authority to "assess a charge for all services rendered by the District against persons, businesses and other entities who are non-residents of the fire protection districts" (70 ILCS 705/11 f(a)); and
WHEREAS, the Lemont Fire Protection District (the "District"), Cook, Will and DuPage Counties, Illinois, is a fire protection district duly incorporated under the laws of the State of Illinois (70 ILCS 705/1); and
WHEREAS, the District renders emergency medical services and other emergency response services, including responding to vehicle fires, on public and private property within or without the District to resident and non-resident
persons, businesses and other entities in the performance of its obligations to the public; and
WHEREAS, the District has previously adopted ordinances assessing fees for the rendering of emergency medical services; and
WHEREAS, the Board finds that it is necessary and proper at this the time to set a new rate structure for ambulance user fees, replacing all rate structures of the past; and
WHEREAS, the costs of providing emergency medical services and other emergency response services to the District and its residents has steadily increased; and
WHEREAS, the Board finds that it is in the best interest of the District to charge a greater fee for the rendering of advanced life-support ("ALS") services than for basic life-support ("BLS") services; and
WHEREAS, the Board finds that it is in the best interest of the District to increase its fees for providing emergency ALS and BLS services; and
WHEREAS, the Board finds that it is in the best interest of the District to charge a fee for responding to vehicle fires, on public and private property within or without the District to non-resident persons, businesses and other entities.
WHEREAS, the Board finds that it is in the best interest of the District to charge for restitution under Section 11-501 of the Illinois Vehicle Code or a similar provision of local ordinance.
NOW, THEREFORE, Be It Ordained, by the Board of Trustees of the Lemont Fire Protection District, Cook, Will and DuPage Counties, Illinois, as follows:
Section One: That the fee for providing ALS service to non-residents of the District will be increased from $650.00 to $750.00, and the fee for providing ALS service to residents of the District will be increased from $450.00 to $550.00
beginning January 1, 2010.
Section Two: That the fee for providing BLS service to non-residents of the District will be increased from $550.00 to $650.00, and the fee for providing BLS service to residents of the District will be increased from $350.00 to $450.00 beginning January 1, 2010.
Section Three: That the following additional fees are also imposed:
Oxygen $ 50.00
Telemetry $ 60.00
IV Supplies $ 45.00
Mileage (loaded per mile) $ 10.00
Immobilization $100.00
Extrication $350.00
Section Four: That the fee for responding to vehicle fires to non-residents of the District shall be computed as defined in Illinois Complied Statues 70 ILCS 705/11f.
Section Five: Any individual convicted of a violation of Section 11-501 of the Illinois Vehicle Code or a similar provision of local ordinance, whose operation of a motor vehicle while in violation of Section 11-501 or such ordinance proximately caused an incident resulting in an appropriate emergency response, shall be required to make restitution to the District for the costs of that emergency response not to exceed $1,000.00.
Section Six: Nothing in this Ordinance shall authorized the District to refuse to provide any service to any person, business or entity that has not paid for services previously rendered or that owes any money for services previously
rendered.
Section Seven: All revenue from the charges assessed pursuant to the emergency medical services portion of this Ordinance shall be deposited in the Ambulance Fund of the Lemont Fire Protection District.
Section Eight: All revenue from the charges assessed pursuant to the emergency response services of this Ordinance shall be deposited in the Corporate Fund of the Lemont Fire Protection District.
Section Nine: All ordinances, rules and regulations of the Lemont Fire Protection District which are in conflict with the provisions of this Ordinance and parts of ordinances in conflict or inconsistent with any of the provisions of this
ordinance are hereby repealed to the extent that they conflict with this Ordinance.
Section Ten: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. The Secretary of the Board of Trustees of the Lemont Fire Protection District is hereby authorized and directed to publish this Ordinance in form as required by law and the Chief Administrator is directed to administer the
provisions of this Ordinance, within its intent, meaning and purpose.
